Waiver Form - Invermere Retreat

 

RELEASE, WAIVER OF CLAIM, INDEMNITY AND ASSUMPTION OF RISK

 

READ THOROUGHLY AND CAREFULLY BEFORE SIGNING

 

I, _______________, (the “Yogi/Yogini”) agree and acknowledge that participating in yoga and a yoga retreat has inherent in it numerous risks of physical and/or emotional injury, which may be serious and potentially debilitating.  I understand that the dangers and risks of participating in, or merely attending the Field of Yoga Invermere Retreat include, but are not limited to:  neck and spinal injuries, injury to bones, joints, ligaments, muscles, tendons, and other aspects of my body, general health and well-being, as well as concussion, head injury, and in rare and extreme circumstances, death.  I am also aware and acknowledge the risk if emotional injury or disturbance arising from the deepening of my spiritual experience of yoga.

 

I recognize, and acknowledge that it is my sole responsibility to be aware of and respect my own physical limitations, and I hereby agree and acknowledge that I will never do any practice to the point of physical, or emotional pain or discomfort, at any point in my participation in the activities offered by Tamara Terry, operating as Field of Yoga (“Field of Yoga”) or any other instructor or assistant, during the course of the  Field of Yoga Invermere Retreat.

 

I further confirm, agree and acknowledge that yoga is not a substitute for medical attention, examination, diagnosis or treatment, and that practising yoga is not recommended or safe for all individuals under all conditions.  I confirm that to the extent that I have any physical, medical or emotional conditions, that I have consulted my own physician prior to arrival at the Field of Yoga Invermere Retreat, and that I have been medically cleared to attend and partipate in the practice of yoga as offered in this retreat. 

 

I understand that some of these dangers and risks which are inherent in the nature of the activities taking place during the course of the Field of Yoga Invermere Retreat may arise through the negligence on the part of the persons involved in preparing, organizing, staging and participating in the event, and that some of the risks and dangers are foreseeable, but others are not.  I understand that the dangers and risks of participating in, or merely attending the Field of Yoga Invermere Retreat may result not only in serious injury, but in an impairment of my future abilities to earn a living, to engage in other business, social and recreational activities, and generally to enjoy life.

 

I have read the description of the Field of Yoga Invermere Retreat and am familiar with the dangers, risks and hazards associated with such events.  I acknowledge and agree that I am freely and voluntarily assuming any and all dangers, risks, and hazards arising through my participation in, mere attendance at the Field of Yoga Invermere Retreat and further acknowledge that I am entirely at my own risk.

 

I understand, accept and acknowledge that all arrangements made on behalf of the participants are made by the organizers of the event, Field of Yoga  are made on the sole condition that the organizers shall not be held responsible for any injury, death, accident, illness, delay, loss, damage, act of negligence, or irregularity. Furthermore, Field of Yoga acts only in the capacity of agent for the participant in all matters connected with rental of space for the retreat. Any and all hotel accommodations and transportation to the retreat, as well as any arrangements for activities at times other than during the set retreat hours and location are solely the responsibility of the Yogi/Yogini, and I fully and absolutely release and indemnify Field of Yoga, Tamara Terry and her agents, assistants and other participants from any responsibility or liability for activities conducted outside of the context, times and location of the retreat.

 

Field of Yoga and its respective employees, agents, directors and officers, helpers and assistants and each of them and their respective insurers, heirs, successors, assigns, administrators and executors (the “Releasees”) are not responsible for any loss, damage, personal injury or death to the Yogi/Yogini arising from the Yogi/Yogini participating in or merely attending the Field of Yoga Canmore Workshop for any reason whatsoever, including without limitation, negligence on the part of the Releasees or any of them.

 

I acknowledge that the risks associated with the practice of yoga asana are increased when impaired or under the influence of medication, prescription or otherwise, and I hereby agree not to participate if I am impaired in any way.

 

I hereby remise, release, discharge, waive, indemnify and save harmless the Releasees and each of them from any and all liability, costs (including without limitation, legal costs), claims, demands, damages, actions and causes of action at law and/or equity arising as a result of any loss, damage, personal injury or death suffered by the Yogi/Yogini and/or any third party as a result, directly or indirectly, of my participating in, and/or merely attending the Field of Yoga Canmore Workshop for any reason whatsoever, including without limitation, negligence or partial negligence on the part of the Releasees of any of them.

 

I understand that by signing this document I will be forever precluded from suing or otherwise claiming against the Releasees or any of them for any loss, damage, personal injury or death that I may sustain through my participation in, and/or merely attendance at the Field of Yoga Canmore Workshop.

 

The foregoing release, waiver and indemnity are intended to be as broad and inclusive as is permitted by the law of the Province of Alberta and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

 

ACCEPTANCE OF THE ABOVE by me is evidenced by my acceptance selection on the Registration Form and I agree that no representations, statements or inducements, whether written or oral were made, except as set out in the foregoing written document.
